Terms of Service

By using FormHook you agree to these terms. We have tried to keep them short and plain-English. If something is unclear, email us before you sign up.

1. The service

FormHook is a form backend: you create form endpoints, we receive submissions, store them, optionally email you, and optionally forward them to a webhook URL you configure. We provide a dashboard, an API, and integrations with billing and email providers.

The service is provided "as is" and "as available". We aim for high availability but do not guarantee 100% uptime.

2. Your account

• You must provide a valid email address.
• You are responsible for everything that happens under your account.
• You must keep your API keys and Clerk session secure. We will never ask for your password or your API key in full.
• You must be at least 16 years old to use the service.

3. Acceptable use

You agree not to use FormHook to:

• Send spam, phishing, or other unsolicited bulk messages.
• Collect data from people under 16 or below the age of digital consent in their jurisdiction.
• Collect special-category data without explicit consent and a separate data processing agreement with us.
• Collect data covered by HIPAA, GLBA, or PCI-DSS in a way that makes us a covered business associate or service provider. FormHook is not a HIPAA-compliant service.
• Violate any law or third-party right.
• Interfere with the service or other users' use of it.
• Reverse-engineer, decompile, or attempt to extract source code from the service except as permitted by applicable law.

We may suspend or terminate your account if we reasonably believe you are in violation of this section.

4. Your content

You retain all rights to the form data you submit to FormHook. You give us a limited, worldwide, non-exclusive license to host, store, transmit, and process that data solely to operate the service for you. This license ends when you delete the data or close your account, except where retention is required by law.

We will not access, read, or use your form submissions except as required to operate the service, as required by law or a valid court order, or with your explicit written consent.

5. Plans and payment

• The Free plan is limited to 1 form and 100 submissions per month.
• Paid plans, Starter and Pro, are billed monthly via Dodo Payments.
• Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.
• We may change pricing with at least 30 days' notice. Existing subscriptions continue at the previous price until the end of the current billing period.
• If payment fails, we may suspend paid features after a 7-day grace period.

6. Service changes

We may add, change, or remove features at any time. If a change materially reduces functionality you are paying for, you may cancel your subscription for a pro-rated refund of the unused portion.

7. Termination

• You may close your account at any time from the dashboard.
• We may suspend or terminate your account if you breach these terms, with 14 days' notice where reasonable.
• On termination, we will delete your personal data within 30 days, except where retention is required by law.

8. Disclaimers and liability

To the maximum extent permitted by law, the service is provided without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, our total aggregate liability arising out of or related to the service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your violation of these terms or your use of the service, including any claim that data you submitted to FormHook infringes a third party's rights.

10. Governing law

These terms are governed by the laws of the jurisdiction in which our operating entity is registered, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction, except where mandatory consumer protection laws of your residence apply.

11. Changes to these terms

We may update these terms. Material changes will be announced by email at least 14 days before they take effect. Continuing to use the service after the effective date constitutes acceptance of the new terms.
